1. Delivery / delivery times

1. The delivery of a controller takes place via a parcel service (shipment purchase) to be determined by energielenker at its proper discretion. The packaging is subject to the proper discretion of energielenker.

2. Unless expressly agreed as binding (e.g. by the words “binding delivery date”, “fixed delivery date”, etc.), deadlines and dates for deliveries provided by energielenker constitute non-binding information about planned delivery periods.

3. If the shipment of a product has been agreed, then energielenker owes only the timely, proper delivery of the product to the transport company and is not responsible for delays caused by the transport company.

4. If energielenker is in default with a delivery or service or if a delivery or service becomes impossible for it, for whatever reason, its liability is limited to compensation in accordance with section 13 of these GTC.

2. Transfer of risk on delivery

1. The risk of accidental loss, accidental loss and accidental deterioration of a controller shall, if the shipment has been agreed, pass to the customer as soon as the controller has been handed over to the person performing the transport, even if partial deliveries are made.

2. If the dispatch of a controller is delayed for reasons that lie within the scope of risk of the customer, the risk of accidental deterioration and accidental loss shall pass to the customer upon notification of readiness for dispatch.
